Polls show new Israeli bloc will retain power

JERUSALEM (AP) ? A pair of polls show that the Israeli premier's new alliance with his hard-line foreign minister has failed to produce a boost but could keep them in power after the Jan. 22 election.

Israeli Channel 2 TV's poll Sunday showed the new bloc of Benjamin Netanyahu's Likud and Avigdor Lieberman's Yisrael Beiteinu would maintain the 42 seats they currently hold in the 120-seat parliament. Netanyahu had hoped the merger would boost their numbers.

The poll surveyed 500 people and had a margin of error of four percentage points. It said the Labor Party would finish second with 23 seats.

A separate poll on Channel 10 showed the new hard-line bloc dropping seven seats from its current total. The TV channel did not provide details of how the poll was conducted.

Fukushima fish still radioactive

More than a year and a half after an earthquake and tsunami destroyed the Fukushima Dai-ichi nuclear power plant in Japan, many fish in the area contain levels of radioactive cesium that are just as high as they were soon after the disaster.

The finding suggests that the region's coastal-dwelling fish are still being exposed to new sources of cesium, possibly from the seafloor or from contaminated groundwater that's flowing into the ocean. And even though most fish sampled in the new study had levels of cesium below safe limits for consumption, some fish contained surprisingly large amounts.

Japan has already closed fisheries near Fukushima to reduce human exposure. The new results suggest that it may be a long time before levels of radiation in the ocean decline after nuclear disasters like the Fukushima meltdown.

"If (the cesium) is in the seafloor, it could be many years or even decades for that to go away," said Ken Buesseler, an oceanographer at the Woods Hole Oceanographic Institution in Mass. "That implies we're going to have an issue in coastal fisheries for a long time to come in Japan. We certainly can't say we're out of the woods yet."

"Just because you haven't read about it in the news" lately, he added, "doesn't mean it has gone away."

Because the Japanese rank among the most voracious consumers of seafood in the world, the country's Ministry of Agriculture, Forestry and Fisheries has been closely monitoring radiation levels in coastal fish since the Fukushima disaster in March of 2011.

To play it extra safe, Japan has also tightened restrictions on two radioactive forms of cesium so that fisheries must be closed if levels in fish exceed a limit of 100 units of a measurement called becquerels per kilogram of wet weight. Consuming levels of cesium above that much every day for a year, Buesseler said, would start to constitute a safety risk.

The fisheries agency has been releasing data regularly, including an annual report on more than 8,500 samples of fish, shellfish and seaweed taken from the coastal areas near Fukushima. Even though the data is freely accessible to the public, it can be hard to interpret so much information. So, Buesseler analyzed the numbers to see what kind of patterns they might reveal.

He was immediately struck with the realization that radiation levels in fish had not dropped in the past year. Fish naturally lose a few percent of their concentrations of cesium if they are not re-exposed, Buesseler said, suggesting that the animals are still facing new inputs of the radioactive material.

Cesium levels were highest in fish that live near the seafloor, Buesseler reported today in the journal Science. And bottom-dwellers near Fukushima contained more cesium than did fish that lived further away from the disaster site.

More than 40 percent of fish in the region contained levels greater than the new safe-consumption limit of 100 units per kg. Two greenling fish collected this August contained a surprisingly high level of 25,000 units.

"The most intriguing thing in the study is that one would've expected concentrations to decline significantly if cesium concentrations in the water were declining over the last year," said Nicholas Fisher, an oceanographer at Stony Brook University in New York, whose group detected small amounts of Fukushima-derived cesium in bluefin tuna off the coast of California last year.

ANALYSIS: Avoid Pacific Bluefin Tuna, Radioactive or Not

"The fact that there's no significant decline in these fish suggests that the fish are being exposed to a constant supply of cesium either from their food or from the water."

Because bottom-dwellers contained more cesium than fish living higher up in the water column, cesium may have accumulated in sediments on the seafloor or in the worms and other invertebrates that live in the sediments. And because it takes 30 years for half of a sample of cesium to break down, Buesseler speculated that decades could pass before exposure levels decline significantly.

It's not clear exactly what the results mean for human health. Fisheries near Fukushima remain closed, so it's not possible to purchase seafood contaminated with cesium from the nuclear meltdown.

Even if people were allowed to eat seafood from the area, the Fukushima fish contain far lower levels of cesium than of naturally occurring radioactive materials, including polonium-210 and postassium-40.

These materials are ubiquitous in marine animals, Fisher said, because the Earth has always been radioactive and 99 percent of radiation in the oceans is natural. Of the remaining one percent, most comes from nuclear weapon testing in the 1960s.

"I don't give advice ? people can make up their own minds about whether they'll eat seafood or not, but they should do so with all available information," Fisher said. "They should know that there's a lot of naturally occurring radioactivity."

For his part, Buesseler ate all of the seafood he was offered on a trip to Japan in July.

Beyond Structured Settlements: NASP 2012 Annual Conference - 3

The National Association of Settlement Purchasers (NASP) hosted its 8th annual educational conference October 16-19, 2012 in New Orleans with a record number of attendees consisting of transfer company executives and staff, in-house and outside legal counsel, investors, service providers and, for the first time, primary market participants.

NASP President Matthew Bracy set the conference theme by challenging speakers and attendees to continue to improve the structured settlement secondary market: "We have some of the brightest minds in the country assembled here to discuss the status of this industry and how to improve what we do. And, as is our habit, we have invited people who might have critical things to say about how we are doing and what we can do better. Improvement can only come from the honest and sometimes harsh assessment of outside critics."

One of those critics was keynote speaker Jan Schlictmann who called out "cash now" advertizing as a "primitive denomination". Schlichtmann's broader message echoed Bracy's theme of bettering oneself through self-criticism and the need for higher industry goals. "It is not just who we serve that matters, but how we serve", Schlictmann stated. Schlictmann reviewed his client experience with structured settlements and acknowledged a personal paradigm shift resulting from recent industry developments including low interest rates and the ELNY liquidation.

The Judges Panel has become a regular and popular feature of NASP educational conferences. Moderator Earl Nesbitt encouraged this year's panel members, Judge Patricia Wise, Chancery Court Judge, Hinds County, Mississippi and Judge Dean Lum, Superior Court for King County, Washington, to share their concerns about structured settlement transfers and their advice for transfer company representatives and attorneys. Selected highlights:

  • Judge Wise: "We (Mississippi judges) have a good relationship with transfer attorneys. I don't look at transfers as inherently good or bad. I don't have any preconceived notion whether to approve or disapprove."
  • Judge Lum: "It is not my job to talk someone into or out of a transfer. Judges, however, think about the worst case scenario - a recipient who has just turned 18. The closer to this worst case scenario, the more scrutiny a person receives."
  • Judge Wise: "What judges are looking for is credibility and what structured settlement payees say they will do with the funds. We do focus on whether prior transfers have occurred. Also, the older the payee, the more likely they have the ability to make a good decision."
  • Judge Lum: "Attorneys should prepare the structured settlement payee for his or her court appearance - how to dress and behave; how the best interest test applies; what the impact will be on dependents."
  • Judge Lum: "We have a saying in King County: 'there is no party like ex parte'. In unopposed cases, people try to run things by you. Its kind of like the wild west. In unopposed cases, it is important for attorneys to go the extra mile. Your reputation matters. There are two degrees of separation in the legal profession."

Another regular and popular feature of NASP educational conferences are the small group break out sessions. The individual breakout sessions S2KM attended addressed participants' state-specific experience with:

  • Court Approval Issues - judicial negotiation of discount rates; the meaning of full disclosure; statutory history of the "best interest" test; independent professional advisor qualifications and fees; transfer application exhibits; and the importance of judicial education.
  • Underwriting Issues - annuity provider transfer requirements; "applicable state laws" requirements; judgment creditor issues including bankruptcy and child support; annuity provider administrative fees; and problems related to incompetent payees, identity theft and relatives or friends coercing payees.

The NASP conference doubled down on underwriting issues with an informative presentation about "Life Contingent Transactions" by NASP President-elect Patricia LaBorde. LaBorde, who also served as Chairperson for the 2012 NASP conference and was credited with upgrading the NASP website, discussed the two paths for funding life contingent transactions:

  • Purchasing a life insurance policy to hedge against the risk of an early annuitant death; or
  • Evaluating the risk and pricing the risk into the transaction.

Jack Kelly, a federal lobbyist who assisted NASP in securing enactment of IRC 5891 in 2002, provided a Legislative Update. Kelly summarized NASP's 2012 involvement with legislative proposals in Vermont, Minnesota and New Hampshire. Vermont, in 2012, became the 48th state to enact a structured settlement protection statute. The new Vermont statute is generally based upon the NCOIL Model Act with some variations related to independent professional advisors, notice requirements for certain state agencies and the required court appearance by the structured settlement payee.

Earl Nesbitt, NASP's Executive Director and General Counsel, presented the 2012 Litigation Update. Among several important court decisions, Nesbitt highlighted the Stone Street v. McClendon case which he characterized as an "important victory" for NASP and the structured settlement industry in general. In McClendon, a Louisiana state court found that Travelers Insurance and MetLife had no grounds for withholding payments following a valid transfer of payment rights pursuant to the Louisiana structured settlement protection statute. The court ordered MetLife to pay interest from the date the payments were originally due. Note: S2KM will publish a more detailed review of the McClendon case in a subsequent blog post.

Attorney Joseph Feltes' 2012 NASP presentation titled "Privacy Issues in Structured Settlement Transactions (Part 2)" supplemented his 2011 NASP presentation on the use and disclosure of confidential information by transfer companies. This year, Feltes discussed privacy issues related to electronic and digital communications, especially Internet-based communications. Among other issues, Feltes highlighted: cyber-bullying; the increase in defamation cases; the blurred boundaries between public and private communications; FTC blog rules requiring disclosures of paid endorsements; social media policy and practices; limits on constitutional rights; cloud technology issues; and the importance of company Internet policies.

In his "Primary Market Update", Mark Wahlstrom emphasized why the primary and secondary structured settlement markets are part of the same business. He called the primary market "the secondary market's best friend" despite the primary market's criticism of, and "needless obstacles" for, the secondary market. As one example of "needless obstacles", Wahlstrom mentioned Chartis for aggressively promoting an anti-factoring pledge among its structured settlement brokers.

Wahlstrom described 2012 as "another bad year for the primary market". He characterized declines in primary market annuity premium as a "negative trend that will eventually impact the secondary market" and identified the following causes:

  • The structured settlement is an insular, closed community with aging leadership and a shrinking sales force.
  • Structured settlement annuity providers, and most brokers, lack marketing and innovation skills.
  • Primary market participants are intimidated by the Internet.
  • Instead of offering customer solutions, the primary market continues to sell a single product.
  • With historically low interest rates, that product produces a zero return when you consider inflation.
  • The primary market has not responded strategically to tort reform and increasing competition from other professionals.
  • By continuing their "factoring wars", the primary market has missed opportunities to cooperate with the secondary market.
  • The ELNY liquidation means the primary market can no longer claim all structured settlement recipients have received 100% of their payments.

Kira Brereton, an attorney who specializes in asset-backed securitizations, provided a comprehensive introduction to "Financing Structured Settlements". Her presentation: reviewed a typical transaction structure; provided a market overview including legal and regulatory developments; summarized rating agency considerations; discussed split payment issues; addressed the creditworthiness of insurers backing the collateral pools; considered bankruptcy and receivership issues; and highlighted relevant securities laws and regulations including the Investment Company Act of 1940, private placements, Dodd-Frank and Regulation AB 2.0.

Elizabeth Yingling, a securities law expert, discussed "Implications of Federal and States Securities Laws on Structured Settlements". She addressed fundamental issues such as: What statutes govern securities? What is a "security"? What is an "investment contract"? and How do promotional materials impact the analysis? In addition, Yingling offered a detailed analysis of the "Howey test" and provided practical tips.

Alexander Hamilton Award

NASP also named S2KM blog author, Patrick Hindert, as the 2012 recipient of its Alexander Hamilton Award. NASP has bestowed this award five times "to distinguished individuals who have supported and defended the right to free alienability of property rights. This right is the corner stone of NASP and the foundation of the structured settlement factoring business." Previous Alexander Hamilton Award recipients:

  • State Senator Alan Sanborn of Michigan.
  • U.S. Representative Eric Cantor of Virginia.
  • State Representative Van Tran of California.
  • Earl S. Nesbitt, Esq., of Texas.

In announcing the 2012 award, NASP President Matt Bracy stated: "Hindert was chosen to receive this award based upon his longstanding support of the factoring business and option. In particular, his position as a founder and leader in the primary structured settlement business, who early on recognized the legitimacy and value of the secondary market, led to this honor."

UPS 3Q profit falls on charge; narrows forecast

(AP) ? UPS says it's uncertain how strong the holiday shopping season will be, and that the pace of global growth remains uneven.

But the world's largest package delivery company managed to match Wall Street expectations for third quarter earnings, and shares rose slightly before the market opened Tuesday.

The company reported a drop in third-quarter earnings Tuesday, as declines in its U.S. package and freight business offset improving international operating profit. UPS' net income was hurt by a huge penalty to withdraw from a pension plan. Even without that big charge, net income eased ? although it matched forecasts from Wall Street analysts.

"Our results were achieved in an environment of slowing global trade and changing market dynamics," said Scott Davis, UPS chairman and CEO

The Atlanta company said it is able to better forecast its earnings for the year. It narrowed its outlook to a range of $4.55 to $4.65 per share, from an earlier forecast of $4.50 to $4.75. It predicting adjusted net income will rise between 5 and 7 percent from adjusted results in 2011.

In the most recent quarter, United Parcel Service Inc. earned $469 million, or 48 cents per share, compared with $1.07 billion, or $1.09 per share, a year earlier. Without the huge charge, it earned $1.03 billion, or $1.06 per share. Revenue fell less than 1 percent to $13.07 billion.

Analysts polled by FactSet expected a profit of $1.06 per share on revenue of $13.32 billion.

While operating profit declined at UPS' core US package segment, the international segment produced its highest-ever profit for the summer quarter. The domestic unit is more than double the size of international.

The company's stock price rose $1.04, or 1.45 percent, to $72.60 in premarket trading.

Roku's New Streaming Stick for TVs Lets You Ditch the Set-Top Box ...

According to Forrester Research, more than 32 million U.S. consumers are now using an assortment of devices to watch Web video on their TV sets, from gaming consoles to set-top boxes like Apple TV, Roku and Google TV. These are often considered interim devices, while ?smart? TVs ?- ones that are always Internet-connected ?- ease their way onto the market and into living rooms.

But adding these boxes to your TV setup means factoring in more wires and easy-to-lose remote controls. And finding the right input for the device through the TV remote can leave even the smartest people feeling dumbfounded.

Roku, the California-based company that makes set-top boxes of the same name, has come up with a new solution to this: A wireless stick, not much bigger than a thumb drive, that plugs directly into the back of your TV to stream HD video from the Web ? turning your ?dumb? TV into a smart one, with minimal gadgetry.

The $100 Roku Streaming Stick, available through Roku.com or Amazon.com, offers the same Web apps and the same powerful processor as Roku?s top-of-the-line set-top box, the Roku XS 2 (also $100). This means that all of that streaming goodness is packed into a small stick.

The Roku Streaming Stick also responds to the same remote used for your TV, as well as to a remote control app for iPhone and Android smartphones ? eliminating the need for at least one extra remote.

But there?s one major catch with the Roku Streaming Stick: It only works with a certain type of TV set, one that includes a port called an MHL (Mobile High-Definition Link) port.

While Roku?s CEO Anthony Wood says that the company expects to see more of these TVs on the market within the next year, there are currently around 50 sets and displays sold in the U.S. that are MHL-equipped. And, of those, Roku has certified only a few brands that work really well with the device: Insignia, Apex and Hitachi.

In order to test the stick, I had to shift my regular TV set to the floor and set up a television that Roku delivered to me: a 55-inch, HD Insignia TV that costs $900. Normally, I wouldn?t replace my existing TV with another one just because I wanted to attach a $100 gadget to it, and I?m guessing a lot of consumers would feel the same.

But the plug-and-play stick is convenient. It?s a few inches long and weighs just three ounces. It?s bright purple, and plugs directly into a color-coded MHL port on the backside of MHL TV sets.

It has no wires, and one of the benefits of this technology is that the MHL ports actually charge the product while it?s plugged in, so there?s no need to charge the stick at any point. The set-up took all of 10 minutes, once I plugged the stick into the TV, authenticated the device and registered with Roku on the Web.

Roku says it has more than 500 apps, which it calls ?channels,? on its platform, including popular apps like Netflix, MLB.tv, Hulu Plus, Amazon Instant Video, Vudu and Facebook. Both the Roku XS 2 box and the stick come with Angry Birds, which can be played using Roku?s motion-sensor remote.

Over the past week, I?ve watched a lot of shows and movies through the Roku Streaming Stick, mostly through Netflix, Amazon and Vudu (the last two charge per movie rental or download, unlike Netflix?s monthly subscription). I also listened to NPR radio, streamed music through Pandora, and logged into Roku?s bare-bones Facebook app, which lets users view photos and videos, but doesn?t allow for status updates.

The media-streaming quality was very good. Occasionally, HD movies would pause to buffer, but never for longer than a few seconds. Only one movie channel I checked out, Sony?s Crackle channel, paused consistently, to play short ads. This was annoying, but then again, the Crackle movies were free.

One app missing from Roku?s offerings is YouTube. I?ve spent more hours than I care to admit using Apple TV to watch YouTube videos with friends. Roku also doesn?t have a Web browser. Obama immigration stance locks in Hispanic support

LAS VEGAS (AP) ? Elizabeth Alvisar is exactly the sort of voter Mitt Romney needs.

A victim of the brutal economy in this swing state, the 30-year-old tax preparer has been out of work for months. She's a foe of abortion and gay marriage, and was naturally drawn to the Republican ticket.

But Alvisar has switched her support to President Barack Obama now.

"It's just because of the Dream Act," she said, referring to the president's August executive order that allows people brought into the country illegally as children to avoid deportation if they graduate high school or join the military. "I have a lot of friends who've taken advantage of that opportunity."

In the heavily Hispanic neighborhood where Alvisar lives, unemployment is high and home values are down. But Obama's immigration stance, and especially his executive order, has locked in support from a fast-growing demographic group that has been trending sharply Democratic in the wake of increasingly hard-line Republican positions on immigration.

Obama's campaign is counting on Hispanics providing the margin of victory not just in Nevada, but also in other swing states such as Colorado, Iowa, Virginia and North Carolina

"They know that he's on the right side of the immigration issue and wants to work with Congress for comprehensive immigration reform," deputy campaign manager Stephanie Cutter said. "They know he wakes up every day and thinks about how to secure the middle class and make it easier for young people to enter the middle class."

The importance of Hispanics as a voting bloc and immigration as an election-year issue was brought home during last week's presidential debate. Obama reminded viewers that Romney, who went hard to the right on the issue during the GOP primaries, had argued for "self-deportation" to solve the illegal immigration problem and took advice on the issue from the law professor who helped write Arizona's controversial immigration statute. The Republican challenger noted that Obama had promised to pass an immigration overhaul and had failed.

The Romney campaign says Hispanics, enduring a 9.9 percent jobless rate, which is more than 2 points higher than the national average, are a natural draw for the GOP ticket. "Hispanics are hurting almost more than any other demographic group under the Obama economy," Romney's Spanish-speaking son Craig, a frequent surrogate in the Hispanic community, said in a brief interview. "They're really struggling and they understand that this president has failed them and we need someone who understands how to create jobs."

The Romney campaign opened an office here in September and last week hosted New Mexico's popular Hispanic governor, Susannah Martinez, in an effort to cut into Obama's edge in East Las Vegas, home to 42 percent of Nevada's Hispanic population.

But even some Romney supporters are pessimistic that Republicans can make inroads with a population that, many polls show, favors Obama by a 2-to-1 margin.

"It's going to take several years because we haven't engaged this community at all," said Joel Garcia, a conservative who formed a coalition to recruit Hispanics here. "You've got a lot of Hispanics who are conservative in how they live their lives and their values, but there's this hook in their mouth pulling them left called immigration."

Much like any other group, Hispanics often list the economy, jobs and education as top issues in polls. But the acrimonious immigration debate of the past decade has given that issue extra weight for them. "What started as a war on illegal immigration is now being perceived as a war on Latinos," said Matt Barreto, who polls Hispanics for the company Latino Decisions.

Nevada is a prime example of that dynamic. In 2010, Hispanics helped Senate Majority Leader Harry Reid win re-election against a tea party candidate who promoted her staunch anti-illegal immigration stance. Republican Brian Sandoval, a Hispanic who was elected governor at the same time, only won 33 percent of the Hispanic vote.

Until Obama's executive order, Hispanic activists were frustrated that he Obama had not pursued plans to legalize more illegal immigrants. Instead, his administration was deporting them in record numbers.

"Before President Obama made his decision to go forward with deferred action, it was pretty dismal," said Vicenta Montoya, an immigration attorney and Democratic activist. "I was going to vote for Obama but it wasn't going to be with grand enthusiasm."

Now Obama's order has fired up Montoya and others in East Las Vegas, a swath of shopping centers, tire shops and weathered ranch houses sprawling east from the Strip. It's the neighborhood of the often-unionized people who make Sin City function ? housekeepers, card dealers and taxi drivers.

For some, Obama's order pulled them into politics. Earlier this month, Hector Rivera's father asked him what he was going to do with his future. Rivera, a high school senior who was brought to the United States illegally when he was 5, went to the East Las Vegas Obama campaign office and volunteered.

The teenager already has applied for documents allowing him to work under Obama's program. "It's an opportunity for me and future generations," said Rivera, 17, imagining how his own unborn children could benefit someday. "Even though they'll be born here, I want to get a better job to give them a better opportunity so they can live a better life."

Others, like Sergio Solis, have suffered economically but see the president as on their side. Solis had to close a restaurant in Southern California and move here to work as a salesman for an energy company. But, after approvingly mentioning the Dream Act, Solis said it will take time to correct the country's course following the eight years of the George W. Bush administration.

"This building here, I can dynamite it and destroy it in five minutes," Solis said, gesturing to a supermarket where he was handing out brochures. "But I can't build it back up in five minutes."

The Romney campaign's East Las Vegas office shares a strip mall with a bail bond company and a tortilleria. It opened after volunteers in the neighborhood urged the campaign to set up shop closer to their homes, so they didn't have to drive to the suburbs to phone-bank or collect yard signs.

Susana Loli, 56, is thrilled. The hotel housekeeper didn't vote for Obama in 2008. But as the economy collapsed before his inauguration, she hoped he could keep the country healthy. Now her side business fixing garage doors has shriveled, and she had to sell family property in Peru to stave off foreclosure on her Nevada house.

"With Mitt Romney, we'll have a better future for my children and grandchildren," Loli said. "The Latinos who are going to vote for Obama haven't studied the problem. When you talk to them and explain the situation, then they understand."

Ana Maria Gonzalez, 50, was disappointed that some Hispanics support Obama because of his executive order. She backs Romney because of her faith in his business acumen and moral values, but also because she thinks he's more likely to deliver a humane overhaul of the country's immigration system.

"In four years, President Obama did nothing," Gonzalez said, adding, that she was certain Romney would come up with a way to let Dream Act youth and other deserving illegal immigrants stay in the country.

'Argo' is one of the best movies of the year.

Argo has that solid, kick-the-tires feel of those studio films from the 70s that were about something but also entertained. Only it's as laugh outright amusing as it is sobering.

The movieland satire is laid on thick, but it's also deadly accurate. Schlock has never seemed so patriotic, and Arkin and Goodman have rarely been so good.

Argo is a rollicking yarn, easily the most cohesive and technically accomplished of Affleck's three films so far, but a part of me wishes the director hadn't cast himself in the lead role.

If nothing else, it proves that every so often, the CIA can pull something off - and that yes, Canadians are just about the nicest people on the planet.

The film is a whopper of a tale, one designed for Oscar nominations, Best Picture and Best Director among them.

The film has heart and brains as well as balls, the screenplay delivering a clear and strong story without sacrificing either political or personal context

As a real life human drama, it is extraordinary. As a thrilling movie experience, it is unmissable

A thoroughly enjoyable, well put together movie that flies by, works well and largely succeeds at what it is trying to accomplish. Also one of those movies where it feels like "I should LOVE it - but don't."

Argo feels like a proper old-fashioned 70s thriller, the kind Alan J Pakula used to make: taut and lean, but with dialogue to die for, plus character and attitude to spare.

Impeccably directed, superbly written and brilliantly acted, this is a terrifically entertaining thriller that gets everything right and confirms Ben Affleck as a major directing talent.

For a story about out-of-the-box thinking and high-risk heroism, Argo plays it surprisingly safe.

Former Senator George McGovern, who lost a 1972 presidential bid to?Richard Nixon in a historic landslide,?died early Sunday, his family said in a statement.

The 90-year-old passed away?at a hospice in?Sioux Falls, SD.

Steve Hildebrand, a spokesman for the family, issued a statement to NBC News which read: "At approximately 5:15 am CT [6: 15 a.m. ET] this morning, our wonderful father, George McGovern passed away peacefully at the Dougherty Hospice House in Sioux Falls, SD, surrounded by our family and life-long friends.

"We are blessed to know that our father lived a long, successful and productive life advocating for the hungry, being a progressive voice for millions and fighting for peace.

"He continued giving speeches, writing and advising all the way up to and past his 90th birthday, which he celebrated this summer."

McGovern was a bomber pilot in World War II who became an early critic of the Vietnam War and a leader of the Democrats' liberal wing.? ?He was elected to his first of three Senate terms in 1962.

McGovern ran for president three times, also making a try for the nomination in 1968 and 1984.? ?Despite the 1972 Watergate break-in, Nixon won a second term by a huge landslide.

Thanks everyone for your advice and suggestions. I have already looked into the classes offered in Chicago, and like John stated, I can do the majority online which is awesome. Joshua, I mentioned in my original post that I can not find any "experienced" realtor willing to work with me with so low budget purchases. If I could, believe me I wouldn't want to come out of my pocket with the real estate broker education, but I simply can't find anyone that is why I am so frustrated. I do appreciate the advice.?

The DACA program is a policy, which is abbreviated short for the Deferred Action for Childhood Arrivals program. Since the DACA program is a policy it means that the program can be cut at any point of time. The program DACA has caused a lot of controversy to why illegal immigrants deserve the rights for these benefits. The United States has always been struggling when it came to immigration laws and now Obama passes the DACA program. The DACA program was created for young immigrants in the United States who have no legal status and were brought to the United States as children (??Who Qualifies..??). If that individual is approved for the DACA program they are granted Deferred Action status at the discretion of DHS (Department of Homeland Security) for a period of two years, which gives them two years protection against deportation, a work permit, and drivers license where the drivers license vary by states (??Who Qualifies..??). The DACA program was passed by President Obama on June 15, 2012 and there was an estimated amount of up to 1.75 million people that may be eligible for the DACA program.
As much people there are that are estimated to be eligible for the DACA program most of these individuals are scared to apply for the DACA program. Many of these individuals fear of deportation on them or their family members after applying for the DACA program. These individuals think that they or their parents will be deported now that they have submitted all their information. Other individuals fear if the DACA program being tossed because they think if Obama isn?t re-elected and Romney wins, that Romney will cut the DACA program right away and maybe even start deporting the ones who applied already for the DACA program. There are a lot of mixed emotions towards the DACA program, since the DACA program is a policy it can be tossed at any time. As much people that are fearing the outcome of applying for the DACA program there are the fearless people who are still applying for the DACA program because of the benefits. As of September 11 there has been reported to be 72,000 applications, where there were only 40,000 the month before (??What Early???). There is a lot of speculation to if the DACA applications will go up or down or if they?re waiting to see who will be president next so nobody really is sure what?s going to happen to the DACA program.
The DACA program applies to certain individuals who are under the age of 31, as of June 15, 2012 (??The Deferred Action...??). These certain individuals also had to fit these certain principles: ??Came to the United States before reaching their 16th birthday; were continuously residing in the United States since June 15, 2007 up to the present time (??The Deferred Action???)??. The Second principle is to be physically present in the United States on June 15, 2012, and at the time of making the request for consideration of Deferred Action (??The Deferred Action???). The third principle is to have entered without inspection before June 15, 2012, or lawful immigration status expired before June 15, 2012 (??The Deferred Action???). The fourth principle is to be currently in school, have graduated, or obtained a Certificate of Completion from high school, have obtained a General Education Development (GED) Certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States (??The Deferred Action???). The final principle to these certain individuals to fit into the DACA program is to not have been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety (??The Deferred Action???). All these principles I?ve listed are the individuals who are eligible for the DACA program.
Now that these certain individuals have the right to apply for the DACA program it seems unfair to the rest of the immigrants who are applying for visas, green cards, citizenship, etc. People who are immigrating into the United States that are following the laws have to wait years for their U.S. visas and it can take a very long time just to even come to the United States and gain these benefits like how the DACA program is allowing these individuals to gain these benefits. The DACA program is showing how weak the United States is when it comes to enforcing the immigration laws, now that the DACA program is passed it allows these certain individuals who got smuggled to the United States to easily get these benefits. It seems like the DACA program is unfair to the other immigrants by somewhat cutting in line in front of the other immigrants who have to wait years and years just for this opportunity to live here in the United States permanently and gain benefits. The United States needs to be stricter on their immigration laws.
The United States immigration consists of a green card, citizenship, and U.S. visa. A U.S. visa consists of two types which are called the immigrant visas and nonimmigrant visas. Immigrant visas allow travelers to enter the U.S. in order to live and work permanently in the U.S. A non-immigrant visa allows travelers to enter the U.S. temporarily for a specific reason, such as tourism or business. In order to get a U.S. visa that individual must be secured by those wishing to enter the United States from another country to temporarily visit or work within American territory. Obtaining a U.S. visa can take long depending on which U.S. visa that individual is applying for so it is best that the application is done correctly or else that individual will have to re-apply, which is adding extra years on their wait to live in the United States. A U.S. visa allows that individual to travel to a port of entry, it allows international travelers to be able to come to the U.S. for a wide variety of reasons, such as tourism, work, etc. The process of permanently living in the United States and moving from a country and to be approved for a visa can take years, which is the first step to coming into the United States properly (?U.S. Visas??).
A green card is next obtained after the U.S. visa is complete. A green card is available if that individual belongs to one of the immigrant categories outlined in the Immigration and Nationality Act or by marriage (??Green Card??). Usually all the green card applicants must be eligible to enter the U.S. through employment, investment, family, refugee status, or through some other pre-established means (??Green Card??). Before applying for a green card that individual has to apply for a U.S. visa first. The green card allows that individual to be a permanent residence in the United States, they will also legally live and work in the United States. The green card also lets that individual travel in and out of the country more freely and the green card is the first step towards the U.S. citizenship where one must generally have a Green Card before applying for naturalization, which is U.S. citizenship (??Green Card??). The green card is mainly for that individual to work in any company located in the U.S. territory. Now that the individual has a green card this will allow that person to have more opportunities. Green Card holders allow that individual to legally have their own car, firearms, and any other items the average Americans can own. A green card generally takes only a couple months to obtain or maybe even a couple of weeks.
The final process of immigrating into the United States is to ultimately become a U.S citizen. An individual can apply for citizenship after obtaining a green card that has been valid during the 5 years prior to their application to become a citizenship (??U.S. Citizenship??). The advantage of being a U.S. citizen is the right to vote, being able to reunite your family in the United States. Obtaining citizenship for children born abroad, which means that if you?re a U.S citizen and your child was born outside of the country, he or she could become a U.S. citizen automatically. Another advantage of being a U.S. citizen is the ability to travel freely across U.S. borders, by having a U.S. passport that individual can travel overseas with no problem. Another advantage of being a U.S. citizen is to collect benefits such as social security. Another advantage of being a U.S. citizen is to become a federal employee, which means that you can now be a federal worker. Lastly an advantage of being a U.S. citizen is to become an elected official where most elected posts in this country require a U.S. citizenship (??U.S. Citizenship??). A U.S. citizen varies to how long it takes to obtain it; it may take months or maybe years.
Another controversy towards DACA program is to why all of a sudden Obama passing the DACA program right when Election Day is coming. It seems like Obama is doing this for the votes so that Obama can be re-elected as President and to me personally it sure does look like Obama did this for the votes so that he can be re-elected as President. It doesn?t seem right to make the DACA program official a couple months before Election Day, just seems so fishy. The biggest issue towards the DACA program is to why these individuals who are illegal immigrants should have the right to obtain these benefits when it can take years for other immigrants to obtain these benefits. It bothers me just because the immigration law was enforced already and there is no need to change anything just because there was a lot of pressure towards the immigration law. I don?t think the DACA program should be enforced anymore because I don?t think these individuals deserve these benefits any more than the other immigrants applying for their visa, green card, or citizenship. I just feel like these individuals should?ve applied for their visa like any other person instead of complaining about the immigration law.
